Thousands of people loose their photos every year to fires and flooding tornadoes and hurricanes. Almost every paper photograph in existence is in one way or another slowly loosing the battle with aging, moisture, and mold.Your photo's pigments are fading and their paper quality is being diminished. With these things in mind the risk of loss or damage associated with photo scanning is extremely low on the list. We do everything in our power to protect your precious memories as if they were our own. After scanning we keep a copy of all of your scans until we are certain that you have received your photos and your DVD's. In order to keep our prices as low as possible you will have to agree in advance to the value of your photos in the highly unlikely event that they are lost or damaged.

Limitation of liability

I understand that Nickelscan.com is the marketing division of ScannerMan Inc both of 1706 Arash Circle, Port Orange, FL. I hereby state that I am the owner of any and all photographs that I am sending or will send now or at any time in the future to Nickelscan/ScannerMan Inc. I also understand that in recognition of the relative risks and benefits of the photo scanning service to both myself and Nickelscan/Scannerman Inc, the risks have been allocated such that I agree, to the fullest extent permitted by law, to limit the liability of Nickelscan/Scannerman Inc, it's employees and officers to me for any and all claims, losses, costs, or damages of any nature whatsoever or claims expenses, including attorneys’ fees and costs and expert witness fees and costs, from any cause or causes, so that the total aggregate liability of Nickelscan/Scannermn Inc, its owners,employees, directors,and officers to me shall not exceed $50.00 or in the case of damaged, lost, or stolen photographs, 5 cents ($0.05) per photo whichever is the lesser. It is intended that this limitation apply to any and all liability or cause of action however alleged or arising, unless otherwise prohibited by law. I understand that additional higher limits of liability are available for an additional fee by contacting Nickelscan.com.

Copyright Indemnification Agreement

I understand and agree that Nickelscan/Scannerman Inc will not perform any services on any photographs or images without the permission of the copyright owner. By submitting photographs or images to Scannerman Inc I acknowledge that I am the owner of the copyrights to the photos or images or that I have obtained and am in posession of written permission from the owner of the copyrights to submit them for your services.  I also recognize that because subject matter does not have to bear a copyright notice in order to be protected by copyright law, absence of such notice does not necessarily assure a right to reproduce.I also warrant that no copyright notice has been removed from any material submitted to Scannerman Inc. To support these warranties I agree to indemnify and hold harmless Nickelscan/Scannerman Inc its owners, directors, officers, employees and/or agents for all liability, for any and all expenses, damages and attorney’s fees that may be incurred in any legal action connected with copyright infringement involving the photos or images produced or provided by me.

Exclusive Jurisdiction

I consent to the exclusive jurisdiction of the federal and state courts located in Volusia County Florida in any action arising out of or relating to doing business with Nickelscan.com/Scannerman Inc, I also waive any other venue to which either party might be entitled by domicile or otherwise.
